DISTRBUTION OF 1935 PARITY PAYMENT UNDER 1934 AND 1935 COTTON ACREAGE REDUCTION CONTRACT
NOTICE
This form, containing the rule for distribution under the contract of the parity payment, the instructions for applying that rule, and report of the distribution made, is hereby approved this 19th day of September 1935, and strict compliance with said rule and instructions is required.
All concerned are advised that it is the primary purpose of the Agricultural Adjustment Act and of the Cotton Acreage Adjustment Program to place increased purchasing power in the hands of cotton producers in the form of improved prices and direct cash payments. Under the terms of the cotton contract, parity payments could not be assignment or pledged. The portion of the parity payment which is due to a share tenant or share cropper should not be credited on any old account and should be credited on the current crop account only with the full knowledge and consent of the tenant or cropper.
Henry A Wallace, Secretary of Agriculture.
INSTRUCTIONS.- This Form No. Cotton 135 is a combination with certain revisions of Forms Nos. Cotton 34 and 35, which were used in 1934, and should be executed on a typewriter or in ink or indelible pencil. Every signature is required to be in ink or indelible pencil.
Where division with one or more share tenants or share croppers is required.- If one or more share tenants or share croppers engaged in producing cotton in 1935 on the farm, the producer is obligated under the contract to divide the parity payment with him or them, and section I is to be used to procure the producer's receipt for the parity payment check and also his declaration of trust to distribute the proceeds of such check in accordance with the provisions of the contract and the instruc-tions set forth in section II hereof for distribution of parity payments among producers, share tenants, and share croppers. Section I is to be executed in quadruplicate; the original is to be retained by the county agent in his office files (subject to being forwarded to Washington on instructions) and the three executed carbon copies delivered to the producer, together with the parity payment check. When section III has been properly executed by the producer in triplicate and filed with the county agent and has been examined by him and found by him to be correct, the copy of this form which contains the duplicate of section I and original of section III shall be forwarded to Washington by the county agent through the State Board of review, the duplicate retained by the county agent in his office files, and the triplicate delivered to the producer.
Where there is no division.- In case a separate check is issued to the landlord of a managing-share tenant for his share alone, or in case the producer in 1935 has had no share tenant or share cropper on the farm, this form is not to be used but the receipt for the parity payment check will be taken on Form No.12, Disbursing Unit, Receipt for Checks Delivered.
